O R D E R

The petitioner, who apprehends arrest for the alleged offences under Sections 64, 137(2), 296(b) and 351(2) of BNS 2023, Crime No.04 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on the pretext of marriage, the 1/4

petitioner raped the victim girland thereafter, refused to marry her. Hence the case.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution. The learned counsel further submitted that to wreak vengeance upon the petitioner, a false case has been foisted against the petitioner. However, on instructions, the learned counsel further submits that the petitioner is ready and willing to abide by any conditions that may be imposed by this Court and hence, he prays to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that there are totally four accused in this case, in which the petitioner was arrayed as A1 and that the petitioner on the pretext of marriage, had physical relationship with the de-facto complainant and thereafter, refused to marry her. Hence, he opposed for grant of anticipatory bail to the petitioner.

6. On perusal of the records revealed that the petitioner was employed in Dubai and through Instagram, the petitioner fell in love with the victim girl. He also proposed to marry the victim girl and on the pretext of marriage, the petitioner had committed rape on the victim girl on compulsion. The petitioner had committed very serious and heinous offence and therefore, the custodial interrogation of the petitioner is very much required in this case.

7. In view of the above, this Court is not inclined to grant anticipatory bail to the petitioner.
