This writ petition has been filed for issuance of a writ of mandamus directing the first respondent to take action against the fifth respondent based on the representation made by the petitioner on 29.05.2023.
2. Heard Ms.S.Premakumari, learned counsel for petitioner and Mr.C.Selvaraj, learned Additional Government Pleader appearing for respondents 1 to 4.
3. The petitioner is an elected Councilor of Kannivadi Town Panchayat. The grievance of the petitioner is that the fifth respondent, who is the President of Kannivadi Town Panchayat did not place the accounts during the council meetings. Hence, a representation was made to the first respondent to take action. Since the same did not evoke any response, the 2/4
present writ petition has been filed before this Court seeking for appropriate directions.
4. Learned Additional Government Pleader appearing on behalf of respondents 1 to 4 submitted the written instructions received from the fourth respondent. On going through the same, it is seen that the District Collector, through proceedings dated 10.04.2023, has already directed the accounts to be submitted regularly during the monthly council meeting. Learned Additional Government Pleader, therefore, submitted that pursuant to the direction given by the District Collector, it is the duty of the President to place the accounts before the council meeting.
5. In the considered view of this Court, the so-called representation given by the petitioner on 29.05.2023 is not supported by any acknowledgment. In any case, this Court does not want to stand on technicalities. A direction has already been given by the District Collector, Tirupur District, to the concerned Panchayat to place the accounts during the council meeting that is held every month. This direction has to be complied with and if the same is done, the petitioner may not have any 3/4
grievance.
