A.No.3024 of 2023 in C.S.No. 9 of 2021 S.SOUNTHAR,J.

This application has been filed by the applicant, seeking set aside the exparte decree passed against the applicant.

2. This application was vehemently opposed by the learned counsel for the respondent on the ground that the applicant has not made out the case to condone the delay.

3. In the affidavit filed in support of this application, it is stated that the clerk of applicant's counsel was inflicted with typoid. Due to that reason, there is a delay in representing the papers relating to Appl.D.No.22157 & 74367 of 2023.

4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the application in A.No.3024 of 2023 is allowed.
