This petition has been filed challenging the order passed by the XVII Metropolitan Magistrate Court, Saidapet dismissing the petition filed under Section 156(3) of Cr.PC. https://hcservices.ecourts.gov.in/hcservices/

The main allegation that has been made in the complaint is that the signature of the petitioner has been forged in the Guarantee Deed by the accused persons who had taken loan from M/s.Kotak Mahindra Bank. The fact as to whether any forgery has been committed can be found out only during the course of investigation and therefore, the Court below was not right in rejecting the petition at the threshold. 3.

There shall be a direction to the 4th respondent to register an F.I.R, based on the complaint given by the petitioner and proceed further in accordance with law. 4.

This Criminal Original petition is disposed of accordingly.
