The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 392, 397 & 506(ii) of IPC, in Crime No.59 of 2021 , seeks anticipatory bail.

2. The case of the prosecution is that on 11.02.2021, while the defacto complainant was returning to his work place after lunch, two persons in White Activa Motor Cycle accosted him and struck him on his head. When the de-facto complainant tried to escape, they had taken Rs.1,300/- and cellphone from him. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that there are three previous cases pending against the petitioner and hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the allegations and also the bad antecedent of the petitioner and that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 12.07.2022 mpl
