This Application has been filed seeking to condone the delay of six days in filing the written statement of the 3rd defendant.

2.In the affidavit filed in support of the judges summons, the 3rd defendant had stated that though he had given instructions to prepare the written statement, since the plaintiff had also shown the address wrongly, there was a delay in actual preparation of the written statement. It is also stated that the delay is neither wilful nor wanton.

3.Heard the learned counsel for the plaintiff also.

4.In view of the circumstances stated, this Application stands allowed.

The written statement is to be taken on record.
