(CR.NO.463 OF 2013) Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition that the petitioner shall report before the trial court daily at 10.30 a.m pending disposal of the appeal in Crl.M.P.No.17250 of 2018 in Crl.A.No.604 o 2018 dt 18.12.2018.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.K.THENRAJAN, Advocate for the petitioner and of MS.KRITIKA KAMAL Government Advocate [crl.side] on behalf of the Respondent the court made the following order:- In Crl.M.P.No.17250 of 2018, vide order dated 18.12.2018, this Court suspended the sentence and released the petitioner on bail on various conditions, one of which is that the petitioner shall report before the Trial Court daily at 10.30 a.m. pending disposal of the appeal. The present petition has been filed for relaxing the said condition.

2. Heard Mr.K.Thenrajan, learned counsel for the petitioner and Ms.Kritika Kamal, learned Government Advocate (Crl.Side), who submitted that the petitioner has been complying with the said condition from 08.01.2019.

3. In view of the above, the condition imposed in Crl.M.P.No.17250 of 2018 is modified to the effect that the petitioner shall report before the Trial Court on the first working day of every English calendar month at 10.30 a.m., pending disposal of the appeal. On any particular date, if the petitioner is not able to appear, leave is granted to the petitioner to file an application https://hcservices.ecourts.gov.in/hcservices/

under Section 317 CrPC and appear before the Trial Court on any other day as determined by the Trial Court in lieu of the day on which he would absent.
