Respondents Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents 3 and 4 to survey and demarcate with boundaries of the petitioner's lands in S.Nos.359/2A1 and 359/2B1, to an extent of 0.4.50 hectares, situated at Kammampatti Village, Nallampalli Taluk, Dharmapuri District, with assistance of the 5th respondent police based on her application dated 12.03.2025.

ORDER

This petition is filed seeking a direction to respondents 3 and 4 to conduct a survey and demarcate with boundaries of the petitioner's lands in S.Nos.359/2A1 and 359/2B1, to an extent of 0.4.50 hectares, situated at Kammampatti Village, Nallampalli Taluk, Dharmapuri District, with the

assistance of the 5th respondent police based on her application dated 12.03.2025.

2. The petitioner relies on the sale deed dated 11.08.2022 registered in Document No.4232/2022 on the file of Sub Registrar, Mecheri, Salem District, in respect of her ownership and also based on Patta Nos.3125 and 3126.

3. The learned counsel for the petitioner submits that in view of the objections created by the adjacent land owners, the respondents are not coming forward to survey the properties.

4. Mr.S.J.Mohamed Sathik, learned Government Advocate, taking notice on behalf of the respondents, submits that they are prepared to conduct the survey and complete the same within a period of six weeks.

5. Considering the facts and circumstances of the case and in view of the limited relief prayed for, the writ petition is disposed of with a direction to the third and fourth respondents to conduct the survey of petitioner's lands based on the petitioner's representation dated 12.03.2025, after affording an opportunity and in the presence of all the interested properties. It is made clear that respondents 3 and 4 are at liberty to avail the protection from the fifth respondent police for conducting the survey.
