JUDGMENT

(Delivered by the Hon'ble Chief Justice) The order impugned in this appeal is a common order passed by a learned Single Judge of this court in various writ petitions, one of which, W.P.No.27009 of 2021, was a writ petition filed by appellant.

2. Counsel for appellant states that petition was filed soon after the issuance of show cause notice and not even a reply had been filed, but the impugned order says appellant could file an appeal before the appellate authority.

3. Counsel states appellant is ready and wiling to file reply to the show cause notice within the time prescribed by this court and, thereafter, the adjudicating authority can pass appropriate orders.

4. In view of the statement made by counsel, the appeal is disposed of. Appellant may file reply to the show cause notice within two weeks from the date of this order being uploaded. Thereafter, respondent may adjudicate upon the show cause notice, but before any order is passed, which shall be a reasoned order, personal hearing shall be given to appellant, notice whereof shall be communicated at least five working days in advance. After the hearing, if appellant wishes to file written submissions, appellant may do so within three working days from the completion of the personal hearing.

5. There shall be no order as to costs. Consequently, interim application stands closed.

6. We clarify that we have not made any observation on the merits of the matter.
