The petitioner seeks direction upon the second respondent to register his complaint, dated 12.01.2015, and to investigate the same in accordance with law.

The learned Additional Public Prosecutor for respondent/Police submitted that the dispute herein is between the brothers in respect of a property. The learned Additional Public Prosecutor further submitted that the petitioner did not co-operate with the respondent/Police for enquiry. Hence, the Police issued summons to the petitioner to appear for enquiry. But, the petitioner refused to receive the summon, and hence, it was affixed on the door of the petitioner's premises. Even thereafter, the petitioner did not appear before the respondent/Police. Hence, the complaint petition given by the petitioner was closed. 3.

In view of the abovesaid circumstances, this Court is left with no other option, except to dismiss this Petition. Accordingly, the Criminal Original Petition is dismissed, leaving open to the petitioner to workout his remedy in the manner known to law.
