(Order of the Court was made by D.Krishnakumar, J.) The writ petition has been filed by the Union of India represented by its Secretary, Ministry of Personnel, Public Grievances and Pension, Department of Pension and Pensioners Welfare, New Delhi along with its functionaries challenging the order dated 23.09.2022 passed by the Central Administrative Tribunal, Chennai Bench in O.A.No.1736 of 2018 directing re-fixation of the pension of the second respondent.

2. Though this Court had granted interim stay of operation of the order passed by the Central Administrative Tribunal at the time of entertaining the writ petition on 12.06.2023, so far, the second respondent has not filed the counter affidavit. Therefore, the interim order is made absolute and the writ miscellaneous petition stands disposed of.

3. Accepting the request made by the learned counsel appearing for both parties to take up the writ petition for final disposal, Registry is directed to list the writ petition for final disposal during the second week of Page No.1/3

September, 2023. In the meanwhile, counter affidavit shall be filed by the second respondent.
