ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offences under Sections 353, 506(ii) of IPC r/w. U/s. 25(1A) of Arms Act and U/s. 102 of Cr.P.C. in Crime No.719 of 2021 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the law enforcing agency while intercepting the vehicles, caught the petitioner and other accused persons, who doubtably roamed in the dark. The officials noticed that the petitioner and other accused persons hide deadly weapons on their back and petitioner/A-1 showed knife and threatened the officials. Hence, the law enforcing agency registered the case against the petitioner.
3.The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He further submits that except this allegation there was no other allegation against the petitioner. 4.The learned Government Advocate (Crl. Side) submits that the petitioner/A-1 showed knife and threatened the officials. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5.Considering the facts and circumstances of the case and considering the allegation level against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. -sd/- 23/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
