Respondents Prayer: This Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the respondents to dispose the petitioner's representations dated 17.03.2020 and 19.09.2020 seeking demarcation survey of land comprised in Old S.F.No.162/1B, New Survey No.181/31 bearing patta No.513, measuring about 40 sq. meter situated at Moorarpadu Village, Sankarapuram Taluk, Kallakurichi District in accordance with Tamil Nadu Survey and Boundaries Act, 1923.

ORDER

This Writ Petition has been filed for issuance of Writ of Mandamus, directing the respondents to consider the application submitted by the petitioner, who is seeking for the survey of the land and for marking the boundaries. 2.Mr.Aruldoss, learned Government Advocate appearing on behalf of the respondents submitted that the first respondent has called the petitioner for preliminary enquiry on 19.12.2020 at 03.00 pm. The learned counsel submitted that the petitioner can be present along with all the relevant documents and the 1st respondent will take a decision with regard to conduct of survey in the subject property. https://hcservices.ecourts.gov.in/hcservices/

3.Taking into consideration the facts and circumstances of the case and also of the fact that the 1st respondent has called the petitioner for preliminary enquiry, there shall be a direction to the 1st respondent to conduct the preliminary enquiry after affording opportunity to the petitioner and shall take a decision strictly in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

This Writ Petition is disposed of with the above directions. No costs.
