Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest for the alleged offences under Sections 147, 294(b), 353, 430, 379 and 506(ii) of IPC in Crime No.365 of 2019, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the defacto complainant, who was the Thasildhar, while intercepting the vehicles with other officials, the petitioners caught with illegal transportation of sand by using JCP and with 2 tipper lorries and the petitioners used filthy language and also tried to dash the defacto complainant. Hence, the law enforcing agency registered the case against the petitioners. 3.The learned counsel appearing for the petitioners submit that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl. Side) submits that apart from this case, similar cases are pending against the petitioners. Hence, he vehemently opposed for grant of anticipatory bail to the petitioners.

5. This Court perused its careful consideration to the submissions advanced by the learned counsel on either side and considering the previous cases pending against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners. 6.Accordingly, this criminal original petition is dismissed. -sd/- 23/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
