This writ petition is filed under Article 226 of the Constitution of India seeking writ of mandamus directing the respondents to pass orders for absorption of petitioner as Drawing Master (in the cadre of B.T.Assistant) in the Government schools or Government aided schools in accordance with Section 26 of the Tamilnadu Regularized Private Schools (Regulation) Act, 1973 with continuity of service and other consequential benefits, including arrears of salary in consideration of representation

submitted by the petitioner dated 23.02.2026. For Petitioner(s):

ORDER

This writ petition is filed for the following relief: "To direct the respondents to pass orders for absorption of petitioner as Drawing Master (in the cadre of B.T.Assistant) in the Government schools or Government aided schools in accordance with Section 26 of the Tamilnadu Regularized Private Schools (Regulation) Act, 1973 with continuity of service and other consequential benefits, including arrears of salary in consideration of representation submitted by the petitioner dated 23.02.2026."

2. The petitioner was appointed as a Drawing Master in the Union Teacher Training Institute, Vellore on 05.10.2012 and the appointment was duly approved by the competent authority. The petitioner would submit that in the academic year 2019-2020, the student strength drastically fell below the prescribed limit, leading to issuance of show

cause notice, denying grant-in-aid due to inadequate strength. 3.The case of the petitioner is that the petitioner and other staffs were declared as surplus and therefore, they are entitled to be absorbed in Government or aided institutions as per Section 26 of the Tamil Nadu Recognised Private Schools (Regulation) Act. The petitioner sent a representation dated 23.02.2026, seeking absorption and the same remains unconsidered. Therefore, the petitioner is before this court.

4. Considering the facts and the circumstances of the case and the fact that the petitioner's representation dated 23.02.2026 has not been considered to date, a direction is issued to the 2nd respondent to consider and pass orders on the petitioner's representation on merits and in accordance with law within a period of 6 weeks from the date of receipt of a copy of this order.

5. With the above direction, this writ petition is disposed of. No costs.
