Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the 1st respondent to dispose of the appeals dated 18.02.2023 and 13.11.2023 filed by the petitioner in pursuance to the compensation proceedings Rc.04/2015/BCE/Unit-III dated 18.01.2023 and 08.09.2023 on the file of the 2nd respondent. With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
2. Seeking a direction to the 1st respondent to dispose of the appeals dated 18.02.2023 and 13.11.2023 filed by the petitioner, pursuant to the compensation proceedings Rc.04/2015/BCE/Unit-III dated 18.01.2023 and 08.09.2023 on the file of the 2nd respondent, this writ petition has been filed.
3. Heard both sides and perused the materials placed on record. 2/5
4. It is the grievance of the petitioner that the compensation awarded for her lands viz., an extent of 224 sq.mtrs. acquired for laying National Highways, was unfair and therefore, challenging the said compensation proceedings of the 2nd respondent dated 18.01.2023 and 08.09.2023, appeals filed before the 1st respondent is still under consideration. Hence, the present Writ Petition.
5. Considering the limited relief sought in this writ petition, the 1st respondent is directed to pass appropriate orders on the petitioner's appeals dated 18.02.2023 and 13.11.2023, on its own merits and in accordance with law, within a period of two months from the date of receipt of a copy of this order.
With the above direction, this writ petition is disposed of. No costs. 20.06.2024 gya Index : Yes/No 3/5
