Though the petitioner sought one month further time to complete the pending investigation and to file a report, it is submitted by the learned counsel for the petitioner that the investigation has been completed and the final report has also been filed.
2.The learned counsel appearing for the seventh respondent has submitted that the investigation has not been done in a proper manner and as apprehended by the first respondent, the respondent/Police had filed the report by stating that there was no medical negligence. If the first respondent/petitioner is not satisfied with the investigation carried out by the seventh respondent, the first respondent herein is at liberty to file a protest petition before the concerned Magistrate Court by objecting the closure report filed by the seventh respondent. 3.Since the prayer made in the miscellaneous petition is filed for a limited purpose of extension of time to complete the investigation and
now, the final report itself has been filed as per the direction given by this Court in its order dated 18.02.2023 in W.P.No.5080 of 2023 and WMP.No.5102 of 2023, nothing remains for consideration in so far, thus, this miscellaneous petition is closed.
4. However, it is made clear that the order will not deprive the first respondent for seeking any appropriate remedy by filing appropriate proceedings if the final report filed by the seventh respondent is not satisfactory and the investigation has not been done in accordance with the direction already given by this Court.
