Crl.O.P.No. 12982 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Karthik, who was arrested and remanded to judicial custody on 27.05.2023 for the offences punishable under Sections 4(1)(a) read with Section 4(1-A) of TNP Act in Crime No.322 of 2023 on the file of the respondent police seeks bail.

The learned counsel for the petitioner submitted that, petitioner is an innocent and he has been falsely implicated in a case registered for the offences under Sections 4(1)(a) read with Section 4(1A) of TNP Act in Crime No.322 of 2023. Petitioner is in Judicial Custody from 27.05.2023. Thus, he seeks bail to the petitioner.
3. In response, learned Government Advocate (Crl. Side) submitted that, on 27.05.2023 at about 12.00 hrs, when the respondent police conducted vehicle check at Ambedkar Nagar, they found that, petitioner was found in possession of 14 bottles of brandy bottle ( each containing 180 ml). He further submitted that, apart from this case, there 1/3
are five similar previous cases pending against the petitioner. Hence, he vehemently opposed for grant of bail to the petitioner.
4. In view of the opposition made by the learned Government Advocate (Crl. Side) that petitioner is an habitual offender having five similar previous cases and that investigation is not completed, this Court is not inclined to grant bail to the petitioner. 5.Accordingly, this Criminal Original Petition is dismissed. 17.07.2023 Sma 2/3
