The petitioner, who was arrested and remanded to judicial custody on 27.04.2022 for the offences punishable under Sections 366 of IPC @ 366, 342 of IPC and Section 5(l) r/w 6 of POCSO Act 2012 in Crime No.90 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner kidnapped the victim girl and committed the offence of sexual penetration many times against the willingness of the victim. Hence the complaint.

3. The victim is aged about 15 years. On perusal of the statement recorded under Section 164 of Cr.P.C. it reveals that the petitioner on the pretext of marriage kidnapped the victim girl and committed penetrative sexual assault on her.

4. Therefore, this Court is not inclined to grant bail to the petitioner as the petitioner has committed very serious and heinous offence as against the victim girl aged about 15 years.
