ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.03.2025 for the offences punishable under Section 318(4) of BNS, 2023 in Crime No.209 of 2025, seeks bail.

2.The case of the prosecution is that the petitioner along with the other accused, in the guise of running an unauthorised chit, have collected huge money to the tune of Rs.2,60,66,867/- from various depositors including the defacto complainant and cheated them. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner is having two young children and requested to grant bail. The learned Government Advocate (Crl. Side) would reiterate the prosecution case and contended that the petitioner has cheated by collecting huge amount to the tune of Rs.2,60,66,867/- and that there are 54 witnesses as on date. 4.The learned counsel for the defacto complainant/Intervenor contended that at the false promise and ice coted words of the accused, the Page No.2 of 4

depositors were forced to believe that they will be getting a huge returns, under the pretext, a huge money was deposited believing the words of the petitioners. However, petitioner has cheated to the tune of Rs.2,60,66,867/-. 5.Heard the learned counsel on either side and perused the materials available on record.

6.Considering the gravity of offence and the number of persons who have been cheated, this Court is not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. 21.05.2025 ata/ep Page No.3 of 4
