Prayer: Appeal filed under Section 54 of the Land Acquisition Act, against the Judgment and Decree of the Court of the II Additional Subordinate Judge, Villupuram dated 27.09.2011 made in A.S.No.61/1999.

DECREE: These Appeals coming on for hearing on this day, and upon perusing the memorandum of grounds of appeal, the Judgment and decree of the Court below and the material papers in the case and upon hearing the arguments of Mr.M.Sriram, Advocate for the appellant and of Dr.S.Suriya, Government Advocate (CS) for the Respondent, and this Court while allowing this Appeal Suit doth order and Decree as follows:

1. That the market value of the acquired land be and hereby is enhanced from Rs. 350/- per cent to Rs. 600/-per cent.

2. That the Respondent be and hereby is directed to deposit the enhanced award amount as stated in clause(i) supra within a period of 3 months from the date of receipt of a copy of this order;

3. That the Appellant herein be and hereby is entitled for the interest at 12% per annum to the Market value of the land from the date of 4(1) notification dated 28.02.1996 to 09.02.1998 till the award.

4. In addition to that the Appellant be and hereby is entitled 30% solatium of market value and 9% interest on solatium amount till the date of deposit.

5. That the balance amount shall be paid to the Appellant within a period of three months from the date of receipt of a copy of this order; and

6. That there be no costs in this Appeal Suit. -s/d- Assistant Registrar True Copy Sub-Assistant Registrar lpp To 1.
