2. Heard the learned counsel for the petitioner/ appellant and Mr.G.Purushothaman, learned counsel for the respondent-1/Caveator.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 23 days in filing the above appeal in C.M.A.SR.No.63385 of 2022 is condoned.

4. The Registry is directed to number the appeal, if it is otherwise in order and list the same for admission.
