Respondents Prayer: The Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents 2 and 3 to regularize the petitioner's services in the post of work Assistant as per G.O.Ms. No. 38 RD & PR Dept dated 3.5.2013 and Roc. No. 14436/2012/K3 dated 28.07.2015 in Harur Pappireddi Patti Panchayat Union, Dharmapuri District in the existing vacancy.

By consent, the writ petition is taken up for final disposal at the admission stage itself.

2. According to the petitioner, he was appointed as daily wager in the Nallampalli Panchayat Union, Dharmapuri on 01.01.1996. The Government issued G.O.69, dated 06.08.2012 to regularise the daily wager, who were working for more than 10 years of service. Though the petitioner is entitled for regularisation, his name was left out.

3. The petitioner would further state that the third respondent has sent a proposal to the second respondent vide Roc.No.14436/2012/K3 Dated 28.07.2015 to regularise the service of the petitioner. Since no order was passed, the petitioner sent a representation dated 23.07.2015. Even then, the second respondent has not passed any order, hence, the present writ petition has been filed.

4. Heard Mr.Sudharshana Sunder, learned counsel appearing for the petitioner and Mr.N.Srinivasan, learned Additional Government Pleader, who accepts notice on behalf of the respondents.

5. This Court, considering the submission of the learned counsel for the petitioner and without going into the merits of the case, directs the second respondent to consider the proposals sent by the 3rd respondent dated 28.07.2015 and the representation of the petitioner dated 23.07.2015 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.

The Writ Petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
