O R D E R

This writ petition has been filed seeking a direction to the respondent to treat 333 sanitary workers, who are members of the petitioner-Union, as permanent employees from the date of completion of 480 days of service in the respondentCorporation, with all consequential arrears of pay, further revisions and attendant benefits.

2. The petitioner is a registered trade union and its members are employees of the Chennai Corporation working in various Departments, predominantly in the lower categories. On 26.12.2009, the Government, vide G.O.(Ms) No.256, dated 26.12.2009, decided to extend the Chennai City limits by including 9 Municipalities, 8 Town Panchayats and 25 Village Panchayats within the jurisdiction of the Chennai Corporation. The petitioner states that 908 sanitary workers of the Chennai Corporation, who were earlier working in the said 42 local bodies, were absorbed by the Chennai Corporation. Whileso, the respondent issued a tender notice proposing to outsource the work of cleaning the roads and removing solid waste in Zone Nos.11, 12, 14 and 15 of the Chennai Corporation on contract basis. Aggrieved by the same, the petitioner was constrained to file the present writ petition seeking the above relief.

3. When the matter was taken up for hearing, the learned counsel for the petitioner submitted that, in view of the prayer sought in the writ petition, the petitioner may be given liberty to agitate the rights of its members before the appropriate forum in accordance with the existing laws.

4. Considering the limited request made by the learned counsel for the petitioner, the petitioner is granted liberty to approach the appropriate forum for agitating the rights of its members in accordance with the existing laws.
