Criminal Revision case filed under Section 397 r/w 401 of Cr.P.C, to set aside the order dated 08.12.2020 in C.C.No.02 of 2018 passed by the learned Judicial Magistrate, Rasipuram, Namakkal District by confirming the order dated 05.04.2021 in C.A.No.4 of 2021 passed by the Principal District and Sessions Judge, Namakkal.

ORDER

This Criminal revision case has been filed challenging the order dated 08.12.2020 made in C.C.No.02 of 2018 on the file of the Judicial 1/4

Magistrate, Rasipuram, Namakkal District wherein the trial court had convicted the petitioner for the offence under Section 138 of Negotiable Instruments Act and the petitioner was sentenced to undergo one year of simple imprisonment and was ordered to pay a compensation of Rs.4,30,000/-, which was confirmed by the Principal District and Sessions Judge, Namakkal, vide order dated 05.04.2021 made in C.A.No.4 of 2021.

2. When the matter was taken up for hearing, learned counsel for the petitioner submitted that, during the pendency of this Criminal revision case, the petitioner had already undergone the conviction imposed by the trial court. Learned counsel appearing for the respondent also confirmed the same.

3. In view of the above, as the petitioner had already undergone the conviction of one year of simple imprisonment imposed by the trial court in C.C.No.02 of 2018, this Court is of the view that, nothing survives for further adjudication in this revision.
