[ RESPONDENTS ] Writ Petition filed under Article 226 of the Constitution of India, seeking to issue a Writ of Certiorarified Mandamus to call for the records relating to the order No.PM/Estt./852/A.3/2002-2005, dated 31.05.2005, passed by the 1st respondent and Order No.PM/EEP/4836/2005-2006, dated 27.01.2006, passed by the second respondent and quash the same and consequently direct the respondents to refund the amount recovered so far to the petitioner.

O R D E R

The petitioner filed a writ of Certiorarified mandamus challenging the order of the respondents in regularising his services in the post of driver.

2. The case of the petitioner is that the respondents have not regularised his services from the date of his appointment whereas they have regularised his services with effect from 15.07.1988 i.e., the date on which the petitioner was promoted as Driver Grade-II.

3. This writ petition was filed in the year 2007 and at that point of time, the petitioner was aged about 52 years and after the lapse of 11 years, I do not find anything survives for further adjudication in this matter. Hence, the prayer sought for in the writ petition become infructuous. Accordingly, the writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
