Prayer :- Civil Revision Petition is filed under Article 227 of the Constitution of India, seeking direction to the learned Principal Family Judge, Coimbatore, to dispose of the H.M.O.P.No.1461 of 2019, within a time limit stipulated by this court.

ORDER

This Civil Revision Petition is filed, for seeking direction to the learned Principal Family Judge, Coimbatore, to dispose of the H.M.O.P.No.1461 of 2019, within a time limit stipulated by this court.

2. The learned counsel for the petitioner submitted that the petitioner 1/4

filed H.M.O.P.No. 1461 of 2019, for divorce against the respondent on the ground of cruelty. The respondent has not filed counter in H.M.O.P.No.1461 of 2019, so far. Thereafter, H.M.O.P.No.1461 of 2019 was referred to mediation and the respondent has not co-operated for the mediation as well. Now, the petitioner is making attempts to go to Canada for further studies. Therefore, the present Civil Revision Petition is preferred.

3. The H.M.O.P.No. 1461 of 2019, is filed in the year 2019, and it is reported that even the counter was not filed so far. It is also submitted that the respondent is not co-operating for mediation and there is no possibility for mediation and settlement between the parties. Hence, the Trial Court is required to proceed further to dispose H.M.O.P.No. 1461 of 2019, on merits and in accordance with law.

4. In this view of the matter, the learned Principal Family Judge, Coimbatore, is directed to insist the respondent to file counter within a time to be stipulated by the Trial court and then proceed to dispose the H.M.O.P.No. 1461 of 2019 on merits and in accordance with law, as 2/4

expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order.

5. Accordingly, this Civil Revision Petition is disposed of. No costs.
