ORDER

The present petition has been filed to declare that the acquittal of the petitioner herein by the learned District Munisif-cum-Judicial Magistrate I, Wallajepet, Vellore District made in C.C.No.42 of 2012 dated 18.06.2017, held to be hon'ble acquittal.

On perusal of the judgment in C.C.No.42 of 2012, dated 18.06.2017 passed by the learned District Munsif-cum-Judicial Magistrate I, Walajapet, the acquittal of the petitioner herein, who has been arrayed as the second accused (A2), is on the basis of the evidence and the witnesses, which does not have any clarity and contrary to each other.

In view of the same, it can only be held that the acquittal in so far as the petitioner/second accused is concerned, is honourable acquittal.
