This petition has been listed under the caption "For being mentioned" at the instance of the learned counsel for the petitioner seeking clarification in respect of para 3 of the order dated 14.03.2022 passed by this Court.
2. Learned counsel for the petitioner submits that contentions noted in the last five lines of para 3 of the order dated 14.03.2022 were not raised, however, they have been inadvertently included and the same may be removed and a fresh order copy may be issued, after deleting the irrelevant portion of the order.
3. In view of the submission of the learned counsel for the petitioner and upon careful perusal of the order, para 3 of the order passed by this Court stands modified as under:
"3. The learned Counsel appearing for the petitioners submitted that though the civil suit is pending before the competent civil court, the 3rd respondent herein without issuing notice to the petitioners and without affording an opportunity of personal hearing, changing the names in patta based on the disputed will is not sustainable and the said act of the 3rd respondent is liable to be punished."
4. Registry is directed to make necessary corrections in the order and issue fresh order copy to the parties.
