Learned counsel for the petitioner submitted that this Court by an order dated 01.06.2023 passed in Crl.M.P.No.7611 of 2023 in Crl.O.P.No.11869 of 2023, had modified the condition imposed against the petitioner to the effect that the petitioner shall execute a bond for a sum of Rs.10,000/- with two sureties, out of which, one surety should be the wife of the petitioner, each for a like sum. Now, it is understood that the petitioner is living in relationship with one lady and she is not the legally wedded wife and thereby, he is unable to comply with said condition and despite, bail being granted to him, he is still languishing in jail. Hence, he seeks for further modification of the said condition.

3. Considering the submission made by the learned counsel for the petitioner, the condition imposed as against the petitioner is further modified to the effect that the petitioner shall execute a bond for a sum of Rs.10,000/- with two sureties, each for a like sum. The other conditions shall remain intact.

4. With the above modification, this Criminal Miscellaneous Petition stands ordered.
