Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records of the respondents 1 to 3 in P.H.D/ZHO(VS)/C.No./0047/2022 dated 18.05.2022 and quash the same consequently directing the respondents 1 to 3 to rectify the parents' name of the petitioner at petitioner's birth certificate. ORDER

The petitioner challenges the records of the respondents 1 to 3 in P.H.D/ZHO(VS)/C.No./0047/2022 dated 18.05.2022 and quash the same consequently direct the respondents 1 to 3 to rectify the parents' name of the petitioner at petitioner's birth certificate.

According to the petitioner, the name of the father is K.K.Ravindran and mother name is S.Jaya, but, while recording, the birth of the petitioner in the hospital, the name has been given as Ravikumar and Jayanthi instead of K.K.Ravindran and S.Jaya. According to the petitioner, mistakes have been crept in hospital which has been reflected in the birth certificate, therefore, the same has to be changed. Hence, this petition.

3. The learned counsel for the petitioner has also relied upon One and the Same Certificates dated 08.02.2022 issued by the Government of Kerala, Kanayanoor Taluk Office, indicating the petitioner's father name is K.K.Ravindran and mother is S.Jaya.

4. Heard the learned counsel for the petitioner and the learned standing counsel for the respondents 1 to 3 and perused the materials placed on record.

It is relevant to note that the name of petitioner's parents have beeen carried out in the Birth Certificate of the petitioner only as per the entry made at the time of birth of the petitioner in the hospital, therefore, whether such names have been wrongly given in the hospital or not is a matter of evidence, without proving such fact, merely, on the basis of certificates relied on by the petitioner, this Court cannot direct the authorities to rectify the names of the petitioner's parents in the Birth Certificate. If the petitioner is properly advised, let a suit be filed by the parents of the petitioner seeking a declaration that their original name is K.K.Ravindran and S.Jaya before a competent Civil Court in Chennai. Liberty is granted to file a suit for 3 / 6

declaration to change the name and thereafter, in the event, the suit is decreed, the petitioner is entitled to correction in the birth certificate.
