O R D E R

The petitioner has filed the above Writ Petition to issue a Writ of Mandamus directing the respondents to forthwith consider the petitioner's representation dated 17.02.2014 for issuance of patta in respect of 66 cents in Survey No.224, Samaadhis (Brindavanam of Jeeyar Saints) in favour of "Sri Emperumanar Jeeyar Mutt, "Brindavanam Sri Emperumanar Jeer Swamy Samadhikal", 0.38 cents in Survey No.219, Nandavanam in favour of "Sri Emperumanar Jeeyar Mutt", Hanumar Temple in 0.34 cents in Survey No.218 and Hanumar Temple in Survey Nos.144, 144A in favour of "Sri Thriuvikramaswamy Devasthanam". https://hcservices.ecourts.gov.in/hcservices/

2. Ms. Bhargavi Gopalan, learned counsel appearing for the petitioner, submitted that though the petitioner, who is the agent of Sri Thiruvikramaswamy Devasthanam, has given the representation as early as on 17.02.2014 for the issuance of patta, the respondent has not passed any order sofar.

3. In the counter filed by the respondent, the respondent has stated that the HR & CE Department has also recommended for the issuance of patta in favour of the petitioner's temple. Further, the respondent has stated that the local people objected for issuance of patta in favour of the temple, hence, the respondent has not issued the patta sofar.

4. Mrs. K.Bhuavaneswari, learned Special Government Pleader appearing for the respondent submitted that since the petitioner's representation for the issuance of patta is pending for a long time, the respondent may be directed to consider the same and pass orders in accordance with law, after giving notice to all the interested parties within a time frame.

Having regard to the submissions made by the learned counsel on either side, taking into consideration the limited prayer sought for in the Writ Petition, without expressing any opinion with regard to the merits of the case, I direct the respondent to consider the petitioner's representation dated 17.02.2014 for the issuance of patta and pass orders, after giving notice to all the interested parties, within a period of twelve weeks from the date of receipt of a copy of this order. I also give liberty to the petitioner to produce all the relevant documents before the respondent and the respondent shall consider the same and pass orders in accordance with law. With these observations, the Writ Petition is disposed of. No costs.
