Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the first respondent to consider and dispose of the appeal preferred by the petitioner dated 06.06.2016 against the orders passed by the second respondent in Na.Ka.P2/12900/2015 dated 19.03.2016 within the time frame fixed by this Hon'ble Court.

ORDER

The petitioner was issued with an order of assignment dated 29.1.2010 of the land covered in Survey No.760/4 n Peraiyur Village, Kamuthi Taluk to an extent of 46 sq.mts. After three years, patta was also issued on 10.6.2013 in respect of the said land. Two years thereafter, an enquiry was held on the basis of the complaint that the petitioner has wrongly obtained the assignment order. Based on the enquiry report obtained from the office of the Joint Superintendent of Police, Kamuthi Sub Division on 6.3.2015, the District Revenue Officer, https://hcservices.ecourts.gov.in/hcservices/

Ramanathapuram District, the second respondent herein has passed an order cancelling the order of assignment dated 29.1.2010. The petitioner, being aggrieved, preferred an appeal before the first respondent. As the same is pending for a long time, he has come to this Court for early disposal.

2. The learned Additional Government Pleader for the respondents sought eight weeks time to consider the pending appeal.

3. Accepting her request, this Court hereby directs the first respondent to consider and dispose of the appeal preferred by the petitioner on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
