PRAYER:

This petition is filed under Article 226 of the Constitution of India praying to issue a writ of Certiorarified Mandamus calling for the entire records relating to the impugned order passed by the 1st respondent in his proceedings Mu.Pa.No.1461/13, dated 16.10.2015 and quash the same and consequently directing the respondents to return back the original documents bearing Document No. 5542 of 2013, dated 09.10.2013 to the petitioners.

ORDER

Admittedly, the order impugned is appealable under Section 47-A of the Indian Stamp Act. Therefore, the petitioners are given liberty to file an appeal before the Appellate Authority, against the order impugned, within a period of four weeks from the date of receipt of the copy of this order. https://hcservices.ecourts.gov.in/hcservices/

2. As and when such an appeal is filed by the petitioner within the time granted by this Court, the Appellate Authority will have to decide the same on merits without rejecting the same on the ground of limitation.

With the above direction, the present writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
