Prayer: Transfer Civil Miscellaneous Petition filed under Section 24 of the Code of Civil Procedure, 1908 to withdraw the H.M.O.P. No.103 of 2021 filed by the respondent on the file of Subordinate Court at Tambaram and transfer the same to the Subordinate Court at Tindivanam.

O R D E R

The wife seeks transfer of HMOP No.103 of 2021 filed by the husband seeking dissolution of marriage from the file of the Sub Court, Tambaram to the file of the Sub Court, Tindivanam.

2. The transfer is sought for mainly on the ground of convenience of the wife who is a resident of Kallikuppam Village, Marakkanam Taluk in Villupuram District. The husband is a resident of Mudichur. The proceedings are pending before the Sub Court where the appearance of the parties for every hearing is not required and the transfer sought for is also to a Sub Court. Therefore, considering the convenience of the wife, HMOP No.103 of 2021 is withdrawn from the file of the Sub Court, Tambaram and transferred to the Sub Court, Tindivanam to be tried and disposed of in accordance with law. Tindivanam is required to dispose of HMOP No.103 of 2021 within period of one year from the date of receipt of papers form the Sub Court, Tambaram. The Transfer Civil Miscellaneous Petition is allowed accordingly. No costs. Consequently, connected miscellaneous petition is closed.
