ORDER

The petitioner/accused in Crime No.249 of 2024 for offence under Sections 325 of BNS, 2023, Sections 11(1)(a), 11(1)(b), 11(1)(d) and 11(1)(e) of Prevention of Cruelty to Animals Act, 1960 had filed this petition seeking for a direction to the respondent police.

2. It is seen that earlier the petitioner filed a petition before the trial Court in Crl.M.P.No.663 of 2024 seeking return of the lorry. The Judicial Magistrate No.II, Madhurantagam, by order dated 28.08.2024, dismissed the petition, against which, the petitioner preferred a revision before this Court in Crl.R.C.No.1551 of 2024 and this Court, by order dated 31.01.2025 dismissed the petition. Now the present petition filed for a similar prayer but the reason given is that earlier petition was filed, when the investigation was pending and now the charge sheet has been filed. In any event, once the charge sheet is filed, then the petitioner to approach the trial Court and not this Court directly.

3. In view of the same, this Criminal Original Petition is disposed of giving liberty to the petitioner to file return of property petition before the trial Court in C.C.No.173 of 2025.
