This petition is filed to condone the delay of 97 days in filing the petition to set aside the S.A.No.1205 of 2010 and M.P.No.1 of 2010. 2.The reason given for the delay is that when the appeal was dismissed, the name of Mr.A.Seshan, learned counsel had been printed for the appellant. However, it transpires that Mr.A.Seshan, learned counsel had passed away several years ago and the present counsel Mr.A.M.Packianathan Easter had entered appearance. The appeal had been dismissed without printing the name of the counsel for the appellant properly.

3.I am satisfied with the reasons given in this Civil Miscellaneous Petition and the delay of 97 days is condoned.
