This writ petition is filed under Article 226 of the Constitution of India seeking writ of mandamus directing the first and second respondents to consider and pass orders on the representation made by the petitioners dated 16.02.2023 to include them in the General Provident Fund with all service and monetary benefits.

Mr. J.Pooventherarajan For Respondent(s):` Mr. V.Sivalingam Government Advocate R1 & R2 Order This writ petition is filed for the following relief: "To direct the first and second respondents to consider and pass orders on the representation made by the petitioners dated 16.02.2023 to include them in the General Provident Fund with all service and monetary benefits."

2. The petitioners were initially appointed as Anganwadi Workers on a consolidated pay between the years 1983 and 1998 and subsequently underwent Multi-purpose Health Worker training. Thereafter, their services were regularised in the years 2004 and 2006, respectively. All the petitioners have retired from service on attaining the age of superannuation.

3. The case of the petitioners is that they were brought under the Contributory Pension Scheme introduced by the Government of Tamil Nadu pursuant to GO.Ms.No.259, Finance (Pension) Department dated 06.08.2003, instead of being brought under the benefits of the Tamil Nadu Pension Rules,

1978. According the petitioners, their services prior to regularisation ought to be considered for extending the benefits of the General Provident Fund Scheme. Therefore, the petitioners made a representation dated 16.02.2023 in this regard. Since there is no response, this writ petition has been filed.

Considering the facts and circumstances of the case and the fact that the petitioners' representation dated 16.02.2023 has not been considered to date a direction is issued to respondents to consider the petitioners' representation and pass orders on merits and in accordance with law, within a period of 6 weeks from the date of receipt of a copy of this order.

5. With the above direction, this writ petition is disposed of. No costs. 04-06-2026 Index: Yes/No Speaking/Non-speaking order KAN
