Petitioner seeks quash of proceedings in Crime No.3317 of 2012 pending investigation on the file of first respondent police.

2. Heard learned counsel for petitioner, learned Government Advocate [Crl.side] for first respondent and learned counsel for second respondent.

3. Learned Government Advocate [Crl.side], on instructions, submits that the case registered in Crime No.3317 of 2012 on the file of first respondent police has been closed as 'mistake of fact' and referred charge sheet has also been filed before learned Judicial Magistrate, Alandur. Recording the submission of learned Government Advocate [Crl.side], this Criminal Original Petition is closed. Connected miscellaneous petition is closed. A copy of the referred charge sheet has been given to learned counsel for second respondent. Second respondent is at liberty to move a protest petition within a period of one month from today, if such a course is considered appropriate.
