Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records of the 1st respondent pertaining to the impugned order published in the Official Web Site of the 1st respondent on 17.12.2013 appointing the 2nd respondent as the RGGLV Distributor for Kottakuppam Village and quash the same and further direct the 1st respondent reconduct the selection for RGGLV Distributor for kottakuppam Village afresh as per the procedural conditions laid down clause 3 (b) 3 (h) and Clause 8 of the Advertisement published on 29.05.2013 in Tamil daily Dinakaran Newspaper. ORDER
This writ petition is heard through Video-Conferencing, on account of the COVID-19 pandemic situation.
2. The writ petition is directed against the results of the draw held for the selection of RGGLV Distributor, which was published on the official website of the first respondent dated 17.12.2013 appointing the second respondent as the distributor for Kottakuppam village and sought for re-conduct of the selection for RGGLV distributor for the same village. https://hcservices.ecourts.gov.in/hcservices/
3. Heard the learned counsel appearing on both sides and perused the materials available on record.
4. The learned counsel appearing for the first respondent would submit that the allegations on which the above writ petition is filed against the second respondent were found to be true on verification. Hence, the allotment itself was not awarded to the second respondent. However, the petitioner also could not be awarded the distributorship, in view of the notification from the Ministry of Petroleum and Natural Gas in R-30024/33/2012-MC dated 23.06.2014.
5. As and when the first respondent issues any advertisement calling for application for the distributorship, it is open to the petitioner to take part in the same.
6. In view of the above, the writ petition has become infructuous and the same is dismissed. No costs.
