The appellant in Crl.A.No.439 of 2015 is the 2nd accused in Special Case No.5 of 2010, on the file of Special Judge/Chief Judicial Magistrate, Cuddalore, reporting dead on 12.01.2023.

2. The appellant is Government servant, who was found guilty of offence under Section 13(2) r/w 13(1)(d) and Section 7 of P.C Act, 1988, had preferred this appeal but died pending appeal. His wife Anbarasi has taken an application to implead herself and continue the appeal. The application to implead is filed with a delay of 116 days and therefore, the condonation of the delay is sought for in Crl.M.P.No.8073 of 2013.

3. This Court, after perusing the background of the appeal and hearing the Learned Government Advocate (Crl.Side) appearing for the state, is of the opinion that to meet the ends of justice, the application to condonation of delay in filing the petition got impleaded. Hence, the delay is condoned and Leave is granted. Accordingly, the Crl.M.P.No.8073 of 2023 is allowed. Post this matter on 21.06.2023.
