HONOURABLE MR.JUSTICE SENTHILKUMAR RAMAMOORTHY K.Priya ... Petitioner Vs.

1.The Government of Tamilnadu Rep. by its Secretary Fort St. George Chennai - 9 2.The Tamilnadu Public Service Commission Rep. by its Chairman Frazer Bridge Road V.O.C.Nagar, Park Town Chennai 600 003 ... Respondents PRAYER: The writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, forbearing the 2nd respondent from completing the process of selection for 3550 post of Junior Assistant covered under the recruitment notification No.09/2013 dated 14.06.2013 till the publication of the answer sheets in the TNPSC website as per the press statement dated 06.03.2014 of the 2nd respondent and consequently direct the 2nd respondent to re-evaluate the petitioner OMR answer sheet as per the key answer published by them. ORDER

The petitioner applied for the post of Junior Assistant and Bill Collector in the year 2013. As per the published results, the petitioner obtained 172.5 marks. After examining the key answers published by the 2nd respondent, the petitioner asserts that she should have been awarded 241.5 marks instead of 172.5 marks. The present writ petition was filed under said facts and circumstances. 2.A counter affidavit has been filed on behalf of the 2nd respondent. In such counter affidavit, it is stated that the OMR sheets of the candidate were manually verified and that it was found that the marks awarded to the candidate are correct.

3.By taking into account the averments in the counter affidavit of the 2nd respondent and the fact that the petitioner was not granted interim relief, nothing survives for adjudication in this writ petition. 2/4

4.Learned counsel for the petitioner, however, submits that the OMR answer sheets should be made available to candidates, as assured by the then chair person of the 2nd respondent in a media release. This aspect would warrant consideration in an appropriate case where the challenge remains alive. 5.Therefore, W.P.No.8464 of 2014 is dismissed without any order as to costs.
