This Writ Petition has been filed for a direction to direct the respondents to defer the enquiry proceedings till the completion of the Criminal case.
2. Heard the learned counsel for both sides and perused the materials available on record.
3. The petitioner, while serving as a Head Constable, was involved in four criminal cases for the offence under Section 392 of IPC in different Police Stations, relating to allegations of chain snatching. Consequently, the 2/5
petitioner was arrested and remanded to the Judicial Custody. Hence, the petitioner was deemed to have been suspended from the service and a charge memo has been issued. It is well settled that criminal proceedings as well as Departmental proceedings can go on simultaneously, unless any prejudice is likely to be caused to the delinquent, in which case they cannot be proceeded with simultaneously.
4. In the case on hand, the petitioner is involved in four criminal cases cases for the offence under Section 392 of IPC. Therefore, the Department proceedings have been initiated and are being proceeded with simultaneously. Hence, the relief sought for in the Writ Petition cannot be considered.
5. In the result, this Writ Petition is dismissed. However, the first respondent is directed to complete the disciplinary proceedings within a period of six months from the date of receipt of a copy of this order. No costs. Consequently, connected Miscellaneous Petition is closed. 18.11.2025 Index:Yes/No 3/5
