[Order of the Court was made by R.SUBBIAH, J] The present Contempt Petition has been filed by petitioner alleging noncompliance of the order of this Court passed in W.P.No.33863 of 2013 dated 13.12.2013, wherein this Court had directed respondents to consider the representation of the petitioner positively for award of third incentive increment on merits and in accordance with law and pass orders thereon within a period of eight weeks from the date of receipt of a copy of the order.

2. Heard learned counsel for petitioner and learned Government Advocate appearing for respondents.

3. Today, when the matter is taken up for consideration, it is represented by learned Government Advocate appearing for respondents that as the against the order, which is in contempt, a Writ Appeal has been filed and the same is pending. 2/3

Since a Writ Appeal has been filed against the order, which is in contempt, nothing survives for adjudication in the present Contempt Petition. Accordingly, the Contempt Petition is closed.
