..Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus, to direct second respondent to dispose of petitioner's representations dated 18/02/2022 and 03/03/2026 regarding issuance of fresh death certificate mentioning petitioner's name in wife's column in the death certificate in Registration No.D.2022:33-16382-000795.

ORDER

The present writ petition has been filed for a direction to second respondent to dispose of petitioner's representations dated 18/02/2022 and 03/03/2026 regarding issuance of fresh death certificate mentioning petitioner's name in wife's column in the death certificate in Registration No.D.2022:3316382-000795.

2. Petitioner would submit that third respondent's name viz., Pramila has been erroneously shown in the death certificate of petitioner's husband. Petitioner would submit that she is the legally wedded wife of late T.S.Saravanan and hence, she filed a representation dated 18.02.2022 for correction of the said entry in the death certificate of her husband.

3. Learned Standing Counsel for respondents 1 and 2 would submit that they would carry out correction/cancellation of the death certificate, keeping in view the procedure laid down in Section 15 of the Registration of Births and Deaths Act, 1969 read with Rule 11 of Tamil Nadu Registration of Births and

Deaths Rules, 2000, after issuing notice to petitioner, third respondent and any other interested persons, agreed to by learned counsel for petitioner,

In view thereof, there shall be a direction to second respondent to consider petitioner's representation dated 18.02.2022 on its own merits and pass appropriate orders, keeping in view the procedure laid down in Section 15 of the Registration of Births and Deaths Act, 1969 read with Rule 11 of Tamil Nadu Registration of Births and Deaths Rules, 2000, after issuing notice and affording reasonable opportunity of hearing to petitioner, third respondent and any other interested persons, within a period of four (4) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the case.

5. Accordingly, writ petition stands disposed of. There will be no order as to costs.
