Side) [IN BOTH THE PETITION] PETITION FOR ANTICIPATORY BAIL 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 406, 408, 477 (a), 120(B) of I.P.C. in Cr.No.1 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioners are Ex President and Assistant Secretary of the Primary Agricultural Co-operative Society, Santhapatty, Dharmapuri and are arrayed as A1 and A3 respectively, and are alleged to have disbursed ineligible amount to the tune of Rs.7,26,300/- to A2.

3.The learned counsel appearing for the petitioners would submit that the petitioners have not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl. Side) submitted that out of Rs.7,26,300/-, A3 has repaid only a sum of Rs.1,40,506/- and the balance amount is yet to be recovered.

5.Considering the nature of the allegations levelled against the petitioners, I am not inclined to grant anticipatory bail to the petitioners.
