ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 379 & 430 of I.P.C. and Section 21(1) of Mines & Mineral ( Development & Regulation) Act, 1957 in Cr.No.234 of 2021, seeks anticipatory bail. 2.The case of the prosecution is that when the defactocomplainant/police and his subordinates were on patrol duty found a tractor carrying one unit of river sand which was illegally transported without the permission of the Government. Hence the case was lodged by the defacto-complainant against the petitioner. 3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence prays for grant of anticipatory bail.

4.The learned Additional Public Prosecutor submitted that the investigation is pending in this case and he strongly opposed to grant anticipatory bail to the petitioner.
5. Considering the facts and circumstances of the case, since the petitioner involved in transportation of river sand, this court is not inclined to grant anticipatory bail to the petitioner.
