Writ petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus directing the 1st respondent to dispose the application of the petitioner for Arbitration dated 27.12.2008 and 16.04.2015 to enhance the compensation awarded to the petitioner herein vide the proceedings of the 2nd respondent herein dated 07.05.2008 in Spl.DRo.Roc.1001/07[A1] for acquisition of land of the petitioner herein situate in survey Nos.S.F.No.166/2 at Nilavarapatti village, Salem District within an appropriate time. ORDER

Heard the learned counsel for the petitioner and Mr.R.Lakshmi Narayanan, learned Additional Government Pleader accepting notice for the respondents 1 and 2 and with their consent, the writ petition is taken up for final disposal.

The petitioner has filed this writ petition seeking for issuance of a writ of mandamus to direct the 1st respondent to dispose of the petitioner's application wherein he has prayed for enhancement of compensation awarded by the 2nd respondent for the lands which are acquired from the petitioner. It is seen that pursuant to the application filed by the petitioner, the 1st respondent has issued a notice to the petitioner on 13.04.2015 and in response to the said notice, the petitioner has also submitted his written objections on 16.04.2015 which has been sent by speed post. Learned Additional Government Pleader appearing on behalf of the respondents, submitted that reasonable time may be granted to the 1st respondent to finalise the matter. In the light of the above, there will be a direction to the 1st respondent to take note of the objections given by the petitioner and pass final orders on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order.

The writ petition is disposed of accordingly. No costs.
