ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the respondents 2 to 5 to sanction the subsidy of 25% from the loan amount that has to be paid to the petitioner by the 5th respondent bank, which has already been sanctioned under the SCLCS scheme.

Heard S.Nedunchezhiyan, learned counsel for the

petitioner and Mr.A.Zakir Hussain, learned Central Government Standing Counsel for 1st respondent. The other respondents have been served and their names have also been printed in the cause-lists and there is no representation either in person or through counsel. 3.

The case of the petitioner is that their Micro Scale company is functioning from the year 2013. The 1st respondent has initiated a scheme called Special Credit Link Capital Subsidy Scheme (SCLCS) to facilitate the Micro and Small scale industries by providing upfront capital subsidy of 25% to the existing as well as New Micro Scale companies in the SC/ST category. 4.

The petitioner applied for a loan before the 5th respondent under the SCLCS scheme. The loan was sanctioned by the 4th respondent and the petitioner was instructed to pay 25% of the loan amount, which is the subsidy from the Government. The loan was sanctioned on 22.01.2024 and 25% will have to be given by the Government under the scheme as a subsidy. The process has to take place from the bank which sanctioned the loan and it has to be placed before the 3rd respondent and the 3rd respondent has to take a decision as per the scheme. Since there was no progress, the

petitioner made a representation on 23.10.2014. The same also did not evoke any response. The only response that the petitioner received from the 5th respondent is to the effect that they have already intimated to the 3rd respondent and there is no progress. 5.

Taking into consideration the facts and circumstances of the case and considering the purport of SCLCS scheme, there shall be a direction to the respondents 4 and 5 to place the application before the 3rd respondent along with all the necessary particulars and the 3rd respondent shall deal with the same in line with the guidelines given under the SCLCS scheme and take a decision within a period of four weeks. The entire process shall be completed within a period of six weeks from the date of receipt of the copy of this order. No costs.
