A.No.3180 of 2025 in T.O.S No.29 of 2022 C.V.KARTHIKEYAN,J This application has been filed by the plaintiffs in the suit seeking leave to issue summons to the 2nd Attesting Witness in the Registered Will dated 19.09.1996, K.Bashkaran, residing at T 3, Araniya Apartments, Elcot Avenue, Sholinganallur, Kancheepuram, Tamil nadu600 119.

2. Heard the learned counsel for the respondent/defendant also.

3. In any Testamentary Original Suit, the witness to the Will must also examined and the evidence is tested during the course of trial. In view of that particular reasoning, this application stands allowed.

4. Summons to be issued for the hearing date on 06.08.2025.

5. The said witness to appear before the learned Additional Master No.III on 06.08.2025.

6. List the TOS again before this Court after the evidence of the said witness is recorded in entirety for the court to consider the application Nos.3178 and 3179 of 2025.

7. The respondent may also file his counter in the said applications.
